Divorce / Legal Separation:
​Filing Joint (together) With Children under 18

You will also find two checklists which take you step-by-step through the divorce / legal separation filing process. The checklists break the process down into two parts, Part 1 & Part 2; you must complete both.
​

Part 1 includes: everything you need to initially file your divorce / legal separation. Part 2 includes everything you need to complete after filing.

For qualifying low-income individuals, the courts offer a fee waiver. If you would like to request a fee waiver, you will find the form at the bottom of this page. 

Forms for Divorce/Legal Separation Part 1  of 2

  •  Joint Petition With Minor Children (FA-4110)
  •  Confidential Petition Addendum (GF-179)

  •  Stipulation for Temporary Order – With Minor Children (FA-4126VA)
      (this form is optional and used when spouses agree on all the terms in the document
  •  Temporary Order – With Minor Children (FA-4126VB)
     (this form combines with the above form, FA-4126VA)

  • Affidavit to Show Cause and Request or Hearing for Temporary Order – With Minor Children (FA-4128VA)
    (this form is optional and used when spouses do not agree and need to have a court hearing to discuss issues like child support, placement, and custody)
  • ​Order to Show Cause – With Minor Children (FA-4128VB)
    ​(this form combines with the above form, FA-4128VA)

FEE WAIVER FORMS
If you are unable to pay the filing fees, and meet the income requirements, you can ask the court to waive the fees by completing form CV-410A&B below.  Check out this video tutorial on completing a fee waiver. ​
