Parent Education Classes
In all cases filed for divorce, legal separation, and annulment where there are minor children, both parties are required to attend an approved program, up to 4 hours in length, regarding the effect of divorce or separation on their children. Completion of a parental education program is mandatory unless there is a waiver granted by the Family Court Commissioner.
The judges and the court commissioners also have the authority, under Sec. 767.401, Wisconsin Statutes, to order people involved in any pre-judgment or post-judgment family case, including paternity cases, to attend a parental education program.
To insure the overall quality of the programs, including appropriate content and proper training of the presenters, programs are reviewed and approved by the Family Court Commissioner. Only completion of approved programs will meet the education requirement. If you want a particular program approved that is not on the list, you or the provider must contact the Family Court Commissioner and make that request.
These programs do not take the place of counseling, therapy or mediation. So, counseling, therapy or mediation cannot be substituted for educational programs unless specific permission is given by the Family Court Commissioner.
You may complete these programs together or separately (if the program chosen allows separate attendance). The provider will prepare a Certificate of Completion indicating that a party (or parties) has completed the program, and provide it to the party. In order to fill out the Certificate of Completion, the provider will need to know the names of the parties, the COURT CASE NUMBER and the BRANCH LETTER (Family A, B, C, D or E). BE SURE you bring that information along with you to the session. It would be a good idea to bring along a copy of one of your court papers with the information.
The party attending the program will receive a copy of the Certificate of Completion from the Parent Education provider. The party attending the Parent Education Program shall file the Certificate of Completion with the court, before or at the time of the request for a pre-trial hearing date or for a stipulated divorce hearing date.
