Post Judgment* Options to Change or Enforce Court Orders

*Use these forms when you already have a case number and court orders.  If you do not have these things, seek legal advice.

Modification Motion
​(Notice of Motion and Motion to Change)
  • Used when one parent wants to request a change and the other parent does not agree; 
  • Once filed, this form will result in a court date being issued by the Family Court Commissioner's Office;
  • The parent filing the form will need to make sure the other parent is served with the papers. It recommended to use the Sheriff or a private process server in the County where the other parent lives.

Stipulation & Order
(Stipulation or "Stip")
  • Used when both parents agree to make changes to their current family court orders (for example, custody/placement, child support. arrears balances, tax exemptions);  
  • Once filed, the Court will review it without a court date.  
  • If approved, it will be signed by the Family Court Commissioner's Office and returned to you as the new court orders.  If not approved, it will be returned to you with a letter explaining why it could not be approved.

CONTEMPT
(Order to Show Cause & Affidavit for Contempt)
  • Used when one person is not following the court orders (not just the agreement you may have; it must be written in the court orders);
  • Once filed, this form will result in a court date being issued by the Family Court Commissioner's Office;
  • The parent filing the form will need to make sure the other parent is served with the papers. It recommended to use the Sheriff or a private process server in the County where the other parent lives.
ENFORCEMENT OF PHYSICAL PLACEMENT
  • Used when one person is not following the specific placement schedule in the court orders (not just the agreement you may have; it must be written in the court orders);
  • Once filed, this form will result in a court date being issued by the Judge in your case.
  • The parent filing the form will need to make sure the other parent is served with the papers. It recommended to use the Sheriff or a private process server in the County where the other parent lives.
