Option 1:
FILING SEPARATELY, AND SPOUSES DO NOT HAVE AN AGREEMENT or
FILING JOINTLY AT FIRST, BUT NOW SPOUSES DO NOT HAVE AN AGREEMENT

- Used when spouses have not come to an agreement and a trial may be needed
- Consider family mediation to work toward an agreement and not have to go through a court trial!

Option 2:
FILING SEPARATELY AT FIRST, BUT NOW SPOUSES HAVE AN AGREEMENT
- Used when spouses filed the first part of the case separately, but now have an agreement. Both spouses will need to sign all of the paperwork for the agreement
- This is called a "stipulated" agreement. The forms are slightly different than filing "jointly".
- Do not use these forms and videos if you filed jointly at first and are still continuing jointly!

Option 3:
FILING JOINTLY, AND SPOUSES HAVE AN AGREEMENT
- Used when both spouses filed the first part of the case jointly and agree on all issues. Both spouses need to sign all of the paperwork for the agreement.
- Do not use these forms and videos if you filed separately at first and now have an agreement. You need to file "Stipulated" (See above).

Option 4:
FILING SEPARATELY, BUT HAD TO SERVE BY PUBLISHING NOTICE
IN A NEWSPAPER
IN A NEWSPAPER
- Used when the non-filing spouse cannot be found and service happened by publishing notice in a newspaper.
- The filing spouse must have an Affidavit of Non-service, an Affidavit of Efforts to Serve, Proof of Publication in a Newspaper, and an Affidavit of Mailing by Certified Mail.
- Legal advice is encouraged before publishing, as it should be a last resort! See more information HERE.
